Terms and Conditions of Travelling with Coal River Coaches and Love Tasmania Tours
Contract
These terms and conditions ("conditions") form the basis of the contract between you and RSB Travel Pty Ltd (also trading as Coal River Coaches and Love Tasmania Tours). It is important that you read the contract carefully to ensure that you understand your rights and obligations. Your contract may also include additional terms and conditions applicable to a special offer or promotion, depending on your tour and/or specific terms relating to your destination.
We may amend these conditions from time to time. You will be bound by the current version of the conditions at the time you make your booking.
You confirm your understanding and acceptance of the conditions and the contract by paying your booking deposit or paying any requested part of the price of your tour.
If you make a booking on behalf of any other person, you represent to us that you have their authority to make the booking on their behalf and to legally bind them to the terms of the contract, including the conditions. ‘You’, ‘your guest’ or ‘passenger’ means the person who makes the booking and each person covered by the booking.
All travel involves risks therefore we strongly recommend you take out comprehensive travel insurance with a reputable insurance company, as well as hire-car insurance to cover you against risks associated with your tour and expenses incurred due to cancellations, delays or other disruptions.
Force Majeure:
Very rarely, we may be required by “force majeure” to change or terminate your arrangements after departure. If this situation does occur, we regret we will be unable to make any refunds (unless we obtain any from our suppliers), nor can we pay you compensation or meet any costs or expenses you incur as a result.
RSB Travel Pty Ltd assumes no liability for any loss, damage, or entry of any nature in whole or in part resulting from an Act of God or any other force majeure condition including without limitation: fire, volcanic eruption, environmental pollution or contamination, inclement weather, earthquake, low or high water levels, flood, water or power shortages or failures, tropical storms or hurricanes, riots or civil commissions or disturbances, and any other acts of a similar nature, sabotage, arrests, strikes or labour disruptions, restraint of rulers or peoples, expropriations, acts of terrorism, war, insurrection, quarantine restrictions, government health advisories, or warnings or alerts of any kind of nature, government seizures, refusal or cancellation or suspension or delay of any government authority or any license, permit or authorisation, damages to its facilities or the travel supplier and its facilities, or any other unforeseen circumstances or any other factors unforeseen by RSB Travel Pty Ltd that impacts negatively on, or impacts its ability to fulfill any of its contractual conditions. In the event that any of these conditions apply, RSB Travel Pty Ltd shall be excused, discharged, and released from performance to the extent such performance is so limited or prevented, without liability of any kind.
Booking and Payment
All bookings must be confirmed in writing.
All tour prices are outlined in Australian Dollars. Payments are processed via Rezdy booking platform, unless arranged otherwise.
Full Payment is required at time of booking. For self-drive tours the bond will be placed on hold on the credit card on file 48 hours prior to vehicle collection, unless arranged otherwise. Provided the vehicle is returned full of fuel and there has not been any damage then the bond will be released within 5-7 business days. Booking amendments can be made up to 36 hours prior to pick up (subject to availability).
You may make a booking directly with us or through a travel agent. Your booking will be confirmed only when we have received your booking request and payment.
If you have made your booking through a travel agent, your travel agent should forward your payment to us on your behalf. However, payments by you to your travel agent are not considered to be payments by you to us. We will consider payment has been received by us only when we receive payment from your travel agent.
Any activities or other services we book for you separately to those stated on your booking confirmation are not included in the cost outlined and you must pay the full costs for such additional services separately.
Any changes made to your booking may incur additional costs.
Prices, Inclusions and Fees
All prices are quoted in Australian Dollars.
Coal River Coaches and Love Tasmania Tours directly supply vehicle and transportation services.
Any third-party arrangements are separate and not included within our transportation services. Our agreement with you is to (and you expressly authorise us to) arrange relevant contracts between you and relevant third-party goods and services providers, as may be relevant to the specific tour you have booked.
Coal River Coaches and Love Tasmania Tours exercises due care and skill in choosing third party providers of goods and services but has no control over, and to the extent permitted by law, no liability for, the goods and services provided by relevant third parties.
All third-party arrangements made on your behalf are subject to the terms and conditions of the relevant third party suppliers.
We reserve the right not to honour any published prices that we determine were erroneous due to printing, electronic, or clerical error. If you make a booking based on erroneous pricing, we will give you the option of cancelling the booking and receiving a refund of any amount paid by you or confirming the booking by paying the difference between the erroneous price and the correct price, as determined by us.
Your tour price includes vehicle hire and activities as outlined. Optional activities can be added to the booking at an additional cost.
If you change your booking, other than by varying the departure date, amendment fees may apply. This fee is due to administrative expenses incurred by us in changing your tour and is a genuine and reasonable estimate of our expenses.
If you cancel your booking for any reason prior to departure, you will be liable for the following cancellation fee:
Cancellation fees:
Prior to 21 days before departure date: Free cancellation
20 days to 36 hours before departure date: 20% cancellation
35-24 hours before departure date: 50% cancellation
Within 24 hours or No Show: 100% cancellation
You may also be liable to pay cancellation fees to third party suppliers.
You are responsible for and must pay for all costs and expenses incurred by you as a result of any change made by you to your booking. This includes changes due to illness or other personal reasons.
Cancellation and Changes
If you do not understand and accept the conditions and the terms of the contract, you should not make any payment to us and in this case, we will cancel your booking.
While every endeavour will be made to supply all services as per your booking, we and the operator reserve the right to replace or omit a service. Where possible we will supplement this service with an alternative service. This may not always be possible due to local operators or local conditions.
You may cancel your booking via the Rezdy booking platform or by sending us written notice of cancellation. If you cancel a booking, you may be liable to pay a cancellation fee.
Cancellation: If we cancel a booking, for whatever reason, before departure we will use reasonable endeavours to offer you the closest available alternative. If you do not accept the proposed alternative 7 days of being notified by us of the alternative, We will cancel your booking, refund to you all monies paid directly to us and will have no further liability to you; and we are not liable for any third-party costs you may incur.
Special Assistance
You must report any requirements relating to special needs or assistance to RSB Travel Pty Ltd at the time the booking is made. Operators will make reasonable attempts to accommodate the special needs of passengers, including mobility issues, but is not responsible in the event we are not able to do so, nor are we responsible for any denial of services by other suppliers or operators. Where safe and appropriate, we will attempt to provide extra assistance to passengers where requested. Some of our vehicles are all-ability vehicles and we are proud to offer our assistance where possible and where it is safe for us, our employees, and operators to do so.
Public Holidays
During local or national holidays, some facilities such as museums and restaurants, sightseeing tours and shopping may be limited or not available. Alternatives will be offered whenever possible.
Self-Drive Terms and Conditions
The hire agreement must be completed and a copy of all drivers licenses must be provided prior to vehicle collection.
The renter agrees to drive and maintain the vehicle in a responsible and lawful manner.
Liability of the vehicle includes any and all accessories, such as keys, key lockbox, trailer lock as well as optional extras that may have been added (esky, child seat).
The renter accepts the vehicle, as is, for the dates of coverage listed and with liability insurance as outlined.
Rates are based on 8-hour periods and generally include unlimited kilometers and standard Damage Liability Cover.
-The standard Liability Cover is $2,000.00 (excess). This can be reduced to $1,000.00 at an additional charge of $39.00 per day, on request.
The renter agrees there will be no drivers under 25 (30) – the renter warrants they are over the age of 25 (30) years old and hold a current full driver’s license applicable to the vehicle rented and is not a ‘P’ plater (provisional license holder).
Persons aged between 25-79 years and in possession of a valid driver’s license, may drive the car with the Company’s prior permission. Noting however that some vehicles have a minimum driver age of 30 years (eg. Sprinter). Additional drivers must be fully licensed and nominated on the Rental Agreement.
A copy of the valid driver’s license is required for all operators of the vehicle. The license must remain valid throughout the rental period.
International licenses that are not in English require an English language international permit.
The renter agrees that no persons are authorised to drive or be in control of the rental vehicle other than those stated on this agreement without the written consent of the Company at any time.
The renter must not propel or tow any trailer or vehicle without the written prior approval of the Company.
Vehicles that do not have a luggage compartment may require a luggage trailer to transport luggage.
Some vehicles have automatic side doors. These are not to be operated manually.
A valid credit card and full payment is required to hire a vehicle from RSB Travel and is the responsibility of the person or persons renting the vehicle.
The renter is responsible for checking any fluids (fuel, oil, water, coolant and AdBlue if needed) prior to starting the engine.
The vehicle must be returned in a clean and tidy condition or a minimum cleaning fee of $150.00 will be charged.
No animal or pet is allowed in the vehicle without prior written approval of the Company.
The vehicle must be returned in roadworthy condition and petrol/diesel refueled, or additional charges will apply.
The renter agrees to not use the vehicle for any illegal purpose or in any race or speed test or in contravention of any law concerning the use of motor vehicles.
The vehicle is not to be driven on any unsealed and/or gravel roads or to be taken off road. There is no cover on the vehicle if it is damaged whilst driven on unsealed roads.
The renter agrees not to drive the vehicle under the influence of alcohol or drugs and must maintain a zero ‘0’ blood alcohol level as indicated by analysis of the driver’s breath or blood, throughout the hire period when driving the vehicle.
All accidents must be reported immediately to the Police and the Company, noting the Company must be provided with a copy of the Accident Report.
The Renter must not carry persons for hire (eg Uber services) or carry any inflammable, explosive or corrosive materials unless pre-authorised in writing by the Company.
Any request for any extension of the period of hire, beyond that stated within this agreement, must be made in advance of the return date and time, or the vehicle will be immediately reported as stolen.
You fully release the Company and do not consider them liable for any claims relating to loss or damage to your personal property, or that of any other person(s) property left in or on the vehicle.
Except as provided by law the driver is not considered or deemed to be an agent, employee or servant of the Company.
No rights of the Company can be waived without the written approval of the Company Director.
Damage / Loss / Liability
a)Joint Renters and all drivers are jointly and severally responsible under this agreement.
b)In the event of any damage, the renter will be liable for the excess payment that is applicable to an insurance claim for vehicle damage during the term of the rental period ex the Coal River Coaches depot, 97a Grove Rd in Glenorchy 7010 TAS (or arranged pick-up location) and until the vehicle is returned to a Coal River Coaches representative.
c)If returning the vehicle to an unmanned location the vehicle remains the responsibility of the renter until collected by a Coal River Coaches representative.
d)In the event of damage to the vehicle, due to the Terms and Conditions of this Agreement being breached, the renter is liable to pay the Company for the cost of all damage, including vehicle replacement if insurance becomes void.
e)The renter is responsible for noting at the beginning of the rental any surface damage or other items of note pertaining to the condition of the vehicle. RSB Travel will provide a diagram for the purpose of recording the condition of the vehicle and a list of known existing damages.
f)Parking, speeding and other fines are the renter’s responsibility. We encourage you to pay them immediately, as should you default, additional administration charges will apply.
g)The renter is responsible for the cost of any damage to the vehicle, not caused by normal wear and tear, up to the excess liability.
h)All vehicles are comprehensively insured; however, an excess amount applies in the event of any loss or damage. You do agree that if you have acted, or caused any other person to have acted, in any manner which breaches the terms and conditions of this agreement that you will provide any information and assistance as may be requested and, if necessary, authorise the insurer to bring, defend or settle legal proceedings, however the Company shall have sole conduct of the proceedings.
Further information or questions relating to the Terms and Conditions must be raised prior to rental of the vehicle.
Rental Cost: Per vehicle, charges based on 8 hour/day
Refuelling (if required): $3.00 / litre
Child / Booster Seat (not fitted): $15.00 / day
Esky Hire: $10.00
Additional Driver: $10.00 each
Vehicle Relocation: $110.00 to/from HBA, $55.00 to/from Cruise
Damage Liability Fee: $2,000.00 Excess Reduction Option ($1,000.00 DLF) $39.00 / day
I understand that if any term or condition of this contract is invalid, unlawful, void or unenforceable it shall be capable of severance without affecting any other obligations of the parties.
I have provided all legal and genuine information or documents and fully agree to all the terms and conditions stated within this contract.
